This Terms of Use Agreement, together with any additional terms, policies, guidelines, or rules referenced herein, is a legal agreement between you and Cheerio World Inc., doing business as Star67 (“Star67,” “we,” “us,” or “our”).By accessing or using the Star67 mobile application, website, software, services, avatar systems, video chat functions, communication tools, account features, subscriptions, or any other products or services offered or operated by Star67, collectively, the “Services,” or by checking a box, tapping a button, creating an account, uploading content, or otherwise indicating your acceptance of these Terms, you acknowledge that you have read, understood, and agree to be bound by these Terms.If you do not agree to these Terms, you may not access or use the Services.When using the Services, you may also be subject to Star67’s Community Guidelines, Privacy Policy, Avatar Upload Rules, App Store terms, subscription terms, and any other policies or rules posted within the Services or otherwise made available to you, collectively, the “Rules.” All such Rules are incorporated into these Terms by reference.
The Services are intended solely for adults who are at least 18 years old.The Services are not available to, and may not be accessed or used by, any person under the age of 18.BY ACCESSING OR USING THE SERVICES, YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST 18 YEARS OF AGE.You may not use the Services if you are under 18, if you are legally prohibited from using the Services, or if you have previously been suspended, banned, blocked, or removed from the Services.Star67 has a zero-tolerance policy for minors using the Services. If we believe that you are under 18, are misrepresenting your age, are attempting to contact or exploit minors, or are otherwise creating a safety risk, we may suspend or terminate your access immediately, with or without notice.You agree not to misrepresent your age or identity and not to help any minor access the Services.
Star67 is an adult-only avatar-based random video chat service. The Services allow users to communicate with other users through live video, audio, text, avatar-based visual representations, and other interactive features.Unlike traditional video chat services, Star67 may allow users to appear as animated avatars, virtual characters, masks, filters, effects, or other digital representations instead of displaying their real face. These avatars may be provided by Star67, licensed from third parties, generated through software tools, uploaded by users, or otherwise made available through the Services.You understand that the Services may match you with strangers and that Star67 does not control the identity, intentions, statements, conduct, content, or behavior of other users. You are solely responsible for your interactions with other users.
Subject to your compliance with these Terms and all applicable Rules, Star67 grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to access and use the Services solely for your personal, lawful, non-commercial use.No rights or licenses are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Star67 or its licensors, except for the rights expressly granted in these Terms.Star67 may terminate this license at any time as provided in these Terms.You are solely responsible for complying with all laws, rules, and regulations that may apply to your use of the Services.You agree that you will not, and will not assist, encourage, or enable others to:
Star67 has the right, but not the obligation, to monitor, investigate, moderate, restrict, suspend, or terminate access based on suspected violations of these Terms or the Rules.
Nothing in these Terms or the Rules creates any private right of enforcement by users or any third-party beneficiary rights.
The Services may allow you to create, upload, transmit, stream, display, or otherwise make available content, including live video, audio, text, usernames, profile information, avatar content, reports, messages, feedback, images, files, and other materials, collectively, “User Content.”You are solely responsible for your User Content and your conduct while using the Services. Star67 does not create, endorse, control, verify, or guarantee User Content submitted or transmitted by users.You understand and agree that:
Star67 may, in its sole discretion, monitor, record, review, remove, restrict, moderate, or preserve User Content or user activity for safety, moderation, legal compliance, product improvement, debugging, analytics, user support, or enforcement purposes, subject to our Privacy Policy.
Star67 may record or retain video, audio, screenshots, clips, chat information, session metadata, or related information for safety, legal, moderation, abuse prevention, product quality, debugging, analytics, user support, and to provide a better user experience.
Star67 may use automated tools, human review, third-party service providers, or a combination of these methods to help detect, review, moderate, investigate, or prevent violations of these Terms, the Rules, or applicable law.
Star67 may suspend, terminate, or ban your access to the Services at any time, with or without notice, if we believe you have violated these Terms, violated the Rules, created safety risk, exposed Star67 to legal risk, or engaged in conduct we determine to be harmful or inappropriate.
The Services may allow you to use avatars, avatar assets, masks, filters, effects, virtual characters, digital clothing, accessories, animations, expressions, movements, or other digital representations, collectively, “Avatars.”Avatars may be:
Your use of Avatars is subject to these Terms, the Rules, and any additional avatar-specific restrictions made available by Star67.
You may not use Avatars to:
Star67 may review, approve, reject, remove, disable, modify, restrict, or moderate any Avatar at any time, with or without notice, for any reason or no reason, including if we believe the Avatar violates these Terms, violates the Rules, infringes third-party rights, creates safety risk, or may expose Star67 to liability.
If the Services allow you to upload, submit, import, create, or otherwise provide an Avatar or avatar-related asset, including but not limited to 3D models, VRM files, textures, images, animations, rigs, blendshapes, expressions, clothing, accessories, names, descriptions, tags, metadata, or related files, collectively, “Uploaded Avatar Content,” you represent and warrant that:
You retain whatever ownership rights you may have in your Uploaded Avatar Content. However, by uploading or submitting Uploaded Avatar Content to the Services, you grant Star67 a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, transferable license to host, store, reproduce, display, transmit, stream, perform, modify, adapt, reformat, resize, compress, optimize, moderate, remove, distribute, promote, market, sell access to, monetize, and otherwise use your Uploaded Avatar Content as necessary or useful to operate, provide, improve, promote, protect, monetize, and moderate the Services.
This license includes the right for Star67 to:
Unless Star67 separately agrees in writing, you are not entitled to compensation, royalties, revenue share, credit, attribution, accounting, approval rights, or any other payment or benefit from Star67’s use, display, promotion, monetization, sale, or distribution of your Uploaded Avatar Content.
You acknowledge and agree that Star67 may charge any user, including you, for access to Uploaded Avatar Content, even if you originally uploaded that Uploaded Avatar Content.
You are solely responsible for any claims arising from your Uploaded Avatar Content. You agree to indemnify and hold Star67 harmless from any claims, damages, liabilities, losses, costs, and expenses, including attorneys’ fees, arising from or related to your Uploaded Avatar Content, including any claim that your Uploaded Avatar Content infringes, misappropriates, or violates the rights of any third party, or that Star67 did not have the right to monetize, charge for, promote, display, or distribute your Uploaded Avatar Content.
Star67 does not verify that users own or control the rights to Uploaded Avatar Content. If you believe content on the Services infringes your intellectual property rights, please contact us at support@star67.app.
The Services, including the Star67 application, software, source code, object code, interface, features, functionality, designs, graphics, logos, trademarks, trade dress, text, content, systems, databases, moderation tools, avatar systems, matching systems, and all associated intellectual property rights, are owned by Star67, its affiliates, licensors, or authorized third parties.You may not remove, alter, obscure, copy, imitate, or misuse any copyright, trademark, service mark, logo, trade name, proprietary notice, or other source identifier included in or accompanying the Services.The name “Star67,” the Star67 logo, and all related names, logos, product names, service names, designs, and slogans are trademarks or property of Star67 or its affiliates. You may not use them without our prior written consent.Third-party trademarks, logos, avatars, tools, libraries, marketplace assets, or other third-party materials used in connection with the Services are the property of their respective owners. Their appearance in the Services does not imply endorsement, sponsorship, or affiliation unless expressly stated.
You acknowledge and agree that use of the Services, including interacting with strangers through live video, audio, text, avatars, and other communication features, carries inherent risks.You voluntarily assume all risks arising from your use of the Services, including risks related to:
To the fullest extent permitted by law, you knowingly, voluntarily, and freely assume all risks, known and unknown, arising from your access to and use of the Services, even if those risks arise from the negligence or carelessness of Star67, third parties, other users, or defects in the Services.

You and Star67 agree that any dispute, claim, or controversy arising out of or relating in any way to these Terms, the Services, your access to or use of the Services, User Content, Uploaded Avatar Content, subscriptions, payments, privacy, safety, moderation, termination, or any relationship between you and Star67, collectively, a “Dispute,” will be resolved by binding individual arbitration, rather than in court, except as expressly provided below.Arbitration means that a neutral arbitrator, rather than a judge or jury, will resolve the Dispute. The parties agree to attempt in good faith to resolve the Dispute informally before initiating arbitration. If the Dispute is not resolved within 30 days after notice is received, either party may begin arbitration.
Unless otherwise required by law, arbitration will be administered by JAMS under its applicable consumer arbitration rules then in effect.
The arbitration will be conducted in English by a single arbitrator. Unless otherwise required by law or agreed by the parties, the arbitration will take place in Los Angeles County, California, or remotely by video, phone, or written submissions as permitted by the arbitrator or applicable rules.
The Federal Arbitration Act, applicable federal law, and the laws of the State of California, without regard to conflict-of-law principles, will govern this arbitration agreement and any Dispute.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND STAR67 AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN ANY CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, OR PRIVATE ATTORNEY GENERAL ACTION.
The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class, collective, consolidated, representative, or private attorney general proceeding.
If this class action waiver is found unenforceable as to a particular claim, then that claim must proceed in court and not arbitration, unless otherwise agreed by the parties.
YOU AND STAR67 EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR ALL DISPUTES, WHETHER RESOLVED IN ARBITRATION OR COURT.
Except as provided in the class action waiver section, if any portion of this arbitration agreement is found invalid or unenforceable, that portion will be severed, and the remaining portions will remain in full force and effect.
Some features of the Services may be offered for free, while others may require payment, subscription, in-app purchase, or other fees.
Paid features may include access to Avatars, avatar libraries, premium Avatars, user-uploaded Avatars, subscriptions, bundles, unlocks, tokens, or other digital content, and Star67 may charge users, including the original uploader of an Avatar, to access or use such content.
If you purchase a subscription or other paid feature through Apple’s App Store, your purchase will be processed by Apple and will be subject to Apple’s applicable payment terms, subscription terms, refund policies, and App Store rules. Star67 does not control Apple’s payment processing, billing, renewal, cancellation, or refund decisions.
Subscriptions may automatically renew unless canceled before the renewal date, as described in the App Store at the time of purchase. You are responsible for managing and canceling your subscription through your Apple account settings.
Star67 may change pricing, features, subscription plans, free trials, paid features, premium Avatar access, subscriptions, bundles, in-app purchases, or other paid offerings at any time, subject to applicable law and App Store requirements.
All fees are non-refundable except as required by law or as determined by Apple.
Star67 may use analytics, debugging, crash reporting, performance monitoring, advertising, attribution, retargeting, moderation, and other third-party tools to operate, improve, protect, measure, and market the Services.
These tools may collect or receive information such as device identifiers, advertising identifiers, IP address, app events, crash data, debugging data, usage data, campaign attribution data, and other technical or activity information.
Star67 may use this information to understand how the Services are used, improve performance, fix bugs, prevent abuse, provide a better user experience, measure marketing campaigns, promote Star67, and support safety and moderation.
Our use of information is described in more detail in our Privacy Policy.
These Terms remain in effect while you access or use the Services.Star67 may suspend, restrict, terminate, ban, or delete your access to the Services at any time, with or without notice, for any reason or no reason, including if we believe that you have:
Upon termination, your right to access and use the Services will immediately cease.
All provisions that by their nature should survive termination will survive, including ownership provisions, avatar rights and warranties, disclaimers, assumption of risk, limitation of liability, indemnification, dispute resolution, and general provisions.
Star67 maintains a Privacy Policy that describes how we collect, use, disclose, retain, and protect information related to your use of the Services. The Privacy Policy is incorporated into these Terms by reference.

Star67’s obligations are subject to applicable laws and legal process. Star67 may preserve, disclose, or provide information if required by law, legal process, government request, court order, subpoena, search warrant, or similar legal process, or if we believe disclosure is reasonably necessary to protect the rights, safety, or property of Star67, users, minors, third parties, or the public.

You may not assign, transfer, or delegate these Terms or any rights or obligations under these Terms without Star67’s prior written consent.
Star67 may assign, transfer, or delegate these Terms and any rights or obligations under these Terms at any time, without restriction, including in connection with a merger, acquisition, financing, reorganization, sale of assets, or operation of law.
Star67 may modify, suspend, discontinue, replace, or terminate all or any part of the Services at any time, with or without notice.
Star67 may also modify these Terms from time to time. If we make changes, we will update the “Last Updated” date above and may provide additional notice as required by law.
Your continued access to or use of the Services after revised Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.
Additional terms may apply to certain features, promotions, subscriptions, avatar systems, or services. If additional terms conflict with these Terms, the additional terms will control with respect to the specific feature or service unless otherwise stated.
These Terms do not, and are not intended to, confer any rights or remedies upon any person other than you and Star67.
Star67’s failure to enforce any provision of these Terms will not be considered a waiver of its right to enforce that provision or any other provision in the future.
Except as otherwise provided in these Terms, if any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
These Terms will be governed by and interpreted in accordance with the laws of the State of California and the United States of America, without regard to conflict-of-law principles.
Except for disputes subject to arbitration or small claims court, judicial proceedings must be brought in the state or federal courts located in Los Angeles County, California, unless the parties agree otherwise. You and Star67 consent to personal jurisdiction and venue in those courts.
These Terms, together with the Privacy Policy, Community Guidelines, Avatar Upload Rules, subscription terms, and any other policies or additional terms incorporated by reference, constitute the entire agreement between you and Star67 regarding your access to and use of the Services.These Terms supersede all prior or contemporaneous oral or written agreements, understandings, or communications between you and Star67 regarding the Services.
